Terms of Service
Scope of work
The service agreement defines deliverables, measurable targets, responsibilities, timelines, approvals, and any exclusions before work begins. Changes to that scope and additional costs require written agreement.
Payment terms
Free build applies to standard template sites. Custom features, redesigns, and integrations are quoted separately. Hosting is $20/month and begins only after you approve your preview. Monthly campaigns are billed monthly under a written scope. Monthly management fees and any separate advertising budget are disclosed before commitment. CRM setup is $797, Google PPC setup $1,797, and SEO setup $1,597, each one-time.
No guarantee of results
Results refer to measurable targets defined before work begins. No guarantee of specific results is implied or given. Search rankings, traffic, leads, revenue, and third-party platform decisions are not guaranteed.
Refund policy
One-time build/setup fees are non-refundable once work has begun, unless otherwise agreed in writing or required by applicable law. Any other refund eligibility is defined in your written service agreement. Contact support@herodigitalmarketingagency.com to request review of a billing issue.
Cancellation
No long-term hosting contract. Hosting may be cancelled anytime before the next billing cycle. Campaign terms vary and are confirmed in writing before work begins. Cancellation does not erase charges already incurred or override applicable legal rights.
IP ownership and portability
Site ownership and portability terms are defined in your service agreement. Template, platform, stock media, and third-party license restrictions may apply. Your agreement specifies the handover of content, files, account access, and any applicable rights.
Limitations of liability
To the extent permitted by law, liability for services is limited as set out in your written service agreement. Nothing in these terms excludes liability or consumer rights that cannot lawfully be excluded.
Governing law
These terms are governed by California law, subject to any mandatory rights and protections that apply to you.
